Important: these Terms contain a binding arbitration agreement and a class-action waiver in the “Dispute resolution” section below. Unless you opt out as described there, disputes between you and Velotone LLC will be resolved by individual arbitration rather than in court, and you may not bring or join a class or representative action.
Acceptance of these Terms
These Terms of Service (“Terms”) are an agreement between you and Velotone LLC, a California limited liability company (“Velotone,” “we,” “us,” or “our”). Velotone operates Piano Racer, including the Piano Racer website, game, accounts, iPad app, and related services (together, the “service”).
By creating an account, making a purchase, or otherwise using the service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree to these Terms, do not create an account or use the service.
Velotone succeeded Piano Racer’s founder as the operator of the service. References to Piano Racer’s operator in earlier versions of these Terms now refer to Velotone.
Eligibility and accounts
You must be at least 13 years old to create a Piano Racer account. Piano Racer is not directed to children under 13. If we learn that an account belongs to someone under 13, we put it on hold and delete it, as the Privacy Policy describes.
If you are at least 13 but under the age of majority where you live, you may use Piano Racer only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the service, including any purchase made for your account. Where the law requires a parent’s or guardian’s consent before terms can be enforced against a minor, for example for apps under Texas law, Velotone relies on the consent the app store obtains and verifies and does not enforce these Terms against a minor without it.
You may not use Piano Racer if you are located in a country or region subject to a comprehensive U.S. government embargo or one the U.S. government has designated as supporting terrorism, or if you are on a U.S. government list of prohibited or restricted parties.
You are responsible for providing accurate account information, safeguarding access to your password, Google or Apple account, or any other authentication method Piano Racer supports, and activity occurring through your account.
Notify support@pianoracer.com if you believe your account has been accessed without authorization.
Permission to use Piano Racer
Subject to these Terms, you may use Piano Racer for your personal, lawful piano practice, learning, and entertainment.
This permission is limited, non-exclusive, non-transferable, revocable, and may be suspended or ended if you violate these Terms or if access must reasonably be restricted to protect Piano Racer, its users, service integrity, or third-party rights.
You may not:
- Interfere with or disrupt the service
- Bypass security measures or access controls
- Access nonpublic systems or information without authorization
- Use bots, scrapers, crawlers, or other automated means to access nonpublic systems, bypass access controls, manipulate gameplay, or place an unreasonable burden on the service without authorization
- Submit malicious code or harmful content
- Impersonate another person or misrepresent your identity
- Harass, threaten, or abuse other users
- Manipulate scores, statistics, achievements, or gameplay results
- Use Piano Racer or its content in violation of law or third-party rights
- Copy, modify, distribute, sell, or commercially exploit Piano Racer software or original content except as permitted by law or written authorization
This section does not prohibit ordinary search-engine indexing, accessibility technology, or automation expressly authorized by Velotone.
Your usernames and profile content
You are responsible for the usernames, profile details, avatar choices, and other information you add to Piano Racer (“your content”). Do not use content that is unlawful, offensive, misleading, or that infringes someone else’s rights, and avoid sensitive personal information in anything other players can see.
You keep any rights you have in your content. You grant Velotone a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content as needed to operate, secure, and provide the service, including showing it to the audience your settings allow. This license ends when your content is deleted from the service, except for copies in ordinary backups that expire on their own schedule.
Piano Racer has zero tolerance for objectionable content and abusive users. A username must not be offensive or suggest that you are Piano Racer or its staff. Usernames that contain slurs, sexual or obscene terms, or names reserved for Piano Racer are refused, but no filter catches everything, and we do not review all content before it appears. We may remove, hide, or replace a username or other content that violates these Terms, that is reserved, or that we reasonably believe could harm players, Velotone, or others, make a profile private, and suspend or terminate the accounts responsible.
While signed in, you can report another player or block them from their profile, from your friends and friend requests, or from a leaderboard or the list of Ghost opponents. Blocking ends any friendship between you and stops the other player from finding you, viewing your profile, sending you friend requests, or using your friend links, and each of you stops seeing the other on leaderboards and as a Ghost opponent. The blocked player is not told. We review reports promptly. You can also contact support@pianoracer.com.
Piano Racer and music rights
The Piano Racer software, branding, interface, original graphics, and other original materials are owned by Velotone or its licensors and are protected by applicable intellectual-property laws. “Piano Racer” and its logos are trademarks of Velotone. These Terms do not grant you any right to use them.
Musical compositions, scores, arrangements, engravings, recordings, and related materials may be in the public domain or owned by their respective rights holders. Making material available through Piano Racer does not grant ownership or rights beyond those reasonably necessary to use the service.
Piano Racer’s searchable music library includes a filtered subset of the PDMX MusicXML dataset. Piano Racer excludes entries that PDMX identifies as having conflicting license metadata and entries we identify as likely to be protected by copyright despite their dataset label, such as arrangements of recent film, game, and popular music. Neither dataset labels nor our screening determine the legal status of every underlying work, edition, arrangement, or engraving. We may remove any song from the library at any time.
Copyright complaints
If you believe material available through Piano Racer infringes your copyright, send a written notice to our copyright agent that includes:
- Your physical or electronic signature
- Identification of the copyrighted work you believe is infringed
- Identification of the material, such as the song title, composer, and where it appears in Piano Racer, with enough detail for us to locate it
- Your name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf
Copyright Agent, Velotone LLC, 2108 N St, Ste N, Sacramento, CA 95816; (442) 224-3446; support@pianoracer.com.
We respond to valid notices by removing or disabling access to the material identified and, in appropriate circumstances, by terminating the accounts of repeat infringers. You may also use this address for other rights concerns, such as a trademark or privacy complaint about another player’s content.
Reporting illegal content and moderation decisions
Anyone, with or without an account, can tell us about content in Piano Racer they believe is illegal, such as a username, with the form at pianoracer.com/report or by writing to support@pianoracer.com. Include why you believe it is illegal, where it appears (the username or profile address), your name and email address unless the report concerns child sexual abuse or exploitation, and a statement that you believe in good faith that your report is accurate and complete. Signed-in players can also use Report on another player. We confirm receipt, review reports promptly, and tell you what we decided.
Usernames are checked by an automated filter when they are chosen; reports are reviewed by a person. When we restrict your content or account, for example by replacing your username, making your profile private, or suspending your account, we tell you what we did, why, and which part of these Terms it rests on, unless the law or a safety risk prevents it. You can contest any decision by replying to our email, or by writing to support@pianoracer.com, and a person will review it. This does not limit your right to go to court or, in the European Union, to use a certified out-of-court dispute settlement body.
support@pianoracer.com is also our point of contact for authorities and for users under the European Union’s Digital Services Act; we communicate in English.
Profiles, friendships, race history, Ghosts, and Leaderboards
Profiles are private by default. A private profile is available to you and your accepted Piano Racer friends. A public profile may be viewed by other signed-in Piano Racer users.
Whatever your profile setting, other signed-in players can find your username and avatar through player search, and they appear on friend requests you send and on invitation links you share.
Supported profile information, achievements, and aggregate statistics may be displayed to the audience associated with your chosen setting. You may remove a friend at any time; removing a friend ends that person’s friend-based access to your private profile.
Eligible best performances may be displayed on per-song Leaderboards and made available as asynchronous Ghost opponents. Public profiles may appear in Global views. Private profiles are excluded from Global views but remain available to accepted friends in Friends views. Your own saved best performance may be used in the Self view.
Autoplay and runs at a modified tempo are not eligible. Velotone may replace a saved Ghost when you set a better eligible result and may change ranking or eligibility rules to address errors, abuse, integrity, or gameplay balance.
Friendship features may allow users to connect with one another and view information made available to friends. You are responsible for choosing appropriate profile visibility settings.
Profile information shown to other players does not include your email address, authentication-provider details, login metadata, complete private race history, or internal moderation information.
Race results, scores, accuracy measurements, achievements, and statistics are estimates generated by the service. They may be corrected, recalculated, removed, or invalidated when affected by software errors, abuse, manipulation, ruleset changes, or integrity reviews.
Piano Racer scores, achievements, and statistics have no monetary value and cannot be exchanged for cash.
Coins, cosmetics, and purchases
Signed-in players can earn experience and virtual coins through eligible play and spend coins on cosmetic items such as race characters, keyboard skins, and profile looks. Coins and cosmetics do not affect gameplay, cannot be transferred or exchanged for cash, and are removed when you delete your account. Rewards and prices are shown in Customize. Automated, duplicate, invalid, or manipulated activity may be excluded or corrected.
Coins and cosmetics, including coins you buy and the items you unlock with them, are a limited, personal, non-transferable, revocable license to use virtual items within Piano Racer. Buying coins buys that license, not ownership of the coins or of any item. They are not money, property, or a stored-value instrument, and they cannot be sold, traded, or redeemed for anything outside the service. Velotone may change coin rewards, item prices, and the items offered, but will not remove cosmetics you have already unlocked except as described in these Terms.
Where available on the website, you may also buy coin packs, which Velotone LLC provides, through Stripe checkout. These purchases are sold through Link: Sold through Link, LLC, a Stripe company, is the merchant of record. Link charges your payment method, calculates and collects any applicable sales tax, VAT, or GST, sends your receipt, and handles payment support, refunds it grants, and payment disputes. Your purchase is also subject to the Sold through Link Terms, and the charge appears on your statement from LINK.COM. Velotone remains responsible for delivering coins and for Piano Racer itself.
The website sells coin packs only to buyers whose billing address is in the United States. A payment from anywhere else is refunded in full, and no coins are delivered for it.
Pack prices are in US dollars, and any applicable sales tax and the final total are shown before payment. Purchases are one-time payments, not subscriptions. Coins are delivered to the signed-in purchasing account after payment verification, do not expire while that account remains active, and cannot buy XP or levels. All current cosmetic items remain available through play. A website purchase must be made by an adult (18 or older) using their own payment method, such as a parent or guardian buying coins for a teenager’s account.
In the Piano Racer app for iPad, coin packs are sold only through Apple’s App Store in-app purchase, at the price the App Store shows. Apple charges your Apple Account, collects any applicable tax, applies Ask to Buy and other family controls, and decides refunds under its own terms; Velotone cannot grant or refuse a refund of an App Store purchase. To ask for one, use Apple’s Report a Problem. Coins bought in the app are delivered to the Piano Racer account that was signed in when you bought them, after Velotone verifies the purchase with Apple, and otherwise follow these Terms like coins bought on the website. App Store purchases are also subject to Apple’s Media Services Terms and Conditions.
For missing coins, contact support@pianoracer.com. For accidental website purchases or website refund requests, contact support@pianoracer.com with your receipt or purchase reference. Refund requests are reviewed based on the circumstances and applicable law; this does not limit mandatory consumer rights. You may also ask Link support, which decides requests made to it under Link’s refund policy and may refund a purchase within 60 days where that policy or applicable law allows, even where these Terms would not. Refunds return money through the original payment method, including any tax paid, and remove the corresponding coins, including a proportional share of bonus coins; an App Store refund, or the part of a purchase Apple refunds, removes them in the same way, and if Apple reverses a refund the coins are restored. A payment dispute may temporarily remove those coins; they are restored if the dispute is resolved for Velotone, less any refund. If coins were already spent, your balance may become negative and future earned or purchased coins first cover that shortfall. Account deletion removes remaining coins and cosmetics and is not itself a refund request.
If Velotone stops offering coin purchases or discontinues the service, we will give reasonable advance notice through the service where practical. Unused coins have no cash value except where applicable law requires otherwise.
Feedback
You may voluntarily provide suggestions, ideas, or other feedback about Piano Racer.
You retain ownership of material you already own. By submitting feedback, you grant Velotone a non-exclusive, worldwide, perpetual, irrevocable, royalty-free permission to use, reproduce, modify, and incorporate that feedback into Piano Racer without compensation or an obligation to use it.
Do not submit feedback that you do not have the right to provide.
Availability and changes
Velotone may add, modify, suspend, or discontinue features. The service may occasionally be unavailable because of maintenance, technical problems, security concerns, provider outages, or other circumstances.
Velotone does not guarantee that any particular feature, song, score, statistic, achievement, friendship, profile function, or account capability will always remain available.
Where reasonably practical, significant changes affecting users will be communicated through the service.
Account suspension, termination, and deletion
Velotone may restrict, suspend, or terminate access when reasonably necessary to:
- Address a violation of these Terms
- Protect users or service integrity
- Prevent abuse, fraud, manipulation, or security threats
- Comply with law or valid legal process, including when an account belongs to someone under 13
- Protect third-party rights
- Discontinue the service or a relevant feature
You may stop using Piano Racer at any time. You may request account deletion through available account settings or by contacting privacy@pianoracer.com.
Deletion is handled as described in the Privacy Policy. Certain information may remain temporarily for security, legal compliance, dispute resolution, abuse prevention, or ordinary backup expiration.
Sections that by their nature should continue after account deletion or termination—including provisions concerning ownership, content licenses, feedback, purchases and refunds, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law—will remain in effect.
Third-party services
Piano Racer uses Firebase and Google Cloud for authentication, hosting, database services, Cloud Functions, security, and operational logging, and Google reCAPTCHA on the website and Apple’s App Attest in the iPad app to protect the service from automated abuse. The iPad app asks Apple for your age range through Apple’s Declared Age Range feature. When coin packs are offered, website purchases are sold through Link (Sold through Link, LLC), a Stripe company, as merchant of record, and processed by Stripe; in the iPad app they are sold through Apple’s App Store. Piano Racer uses Google Analytics for website analytics.
The Privacy Policy describes what Google Analytics collects and how to turn analytics off for your browser.
These providers process information under their applicable agreements and data-protection commitments.
If you use Google Sign-In or Sign in with Apple, your Google or Apple account and your use of their services remain subject to Google’s or Apple’s applicable terms and policies. Website coin-pack purchases are also subject to the Sold through Link Terms and Stripe’s privacy policy, and App Store purchases to Apple’s terms and privacy policy.
Velotone is not responsible for outages, interruptions, or changes to third-party services outside its reasonable control.
Disclaimers
Piano Racer is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Velotone disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
Velotone does not guarantee that:
- The service will be uninterrupted, secure, or error-free
- Musical content or gameplay measurements will be completely accurate
- Defects will always be corrected
- Saved information will never be lost
- Profiles, friendships, achievements, or statistics will always remain available or unchanged
- The service will meet every user’s individual needs
Nothing in these Terms excludes or limits any warranty, protection, or right that cannot lawfully be excluded or limited.
Limitation of liability
To the fullest extent permitted by law, Velotone and its members, managers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, use, profits, opportunities, or goodwill, arising out of or relating to Piano Racer or these Terms.
To the fullest extent permitted by law, Velotone’s total liability for all claims arising out of or relating to Piano Racer or these Terms will not exceed the greater of (a) the amount you paid for coin packs, through any store, in the 12 months before the event giving rise to the claim, or (b) US $100.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless Velotone and its members, managers, employees, and agents from third-party claims, losses, liabilities, and reasonable costs, including attorneys’ fees, arising from your violation of these Terms, your content, or your violation of law or someone else’s rights. This does not apply to the extent a claim results from Velotone’s own wrongdoing.
Dispute resolution
Please read this section carefully. It affects how disputes are resolved and your right to go to court.
If you live in the United Kingdom, the European Economic Area, or Switzerland, this section does not apply to you; see “If you live in the UK, the EEA, or Switzerland” below.
Informal resolution first. Before starting an arbitration or small claims case, you and Velotone agree to try to resolve any dispute informally. Send a written notice describing the dispute, the relief you want, your name, and your account email to support@pianoracer.com or to Velotone LLC, 2108 N St #4486, Sacramento, CA 95816. We will send any notice to you at your account email. If the dispute is not resolved within 60 days after the notice is received, either party may start a proceeding as allowed below. Deadlines for bringing a claim are paused during those 60 days.
Agreement to arbitrate. Except as provided below, you and Velotone agree that any dispute, claim, or controversy arising out of or relating to these Terms, the service, or any purchase, whether based on contract, statute, tort, or any other legal theory (a “Dispute”), will be resolved by binding individual arbitration. The Federal Arbitration Act governs the interpretation and enforcement of this section. The arbitrator decides all issues about the scope and enforceability of this agreement to arbitrate, except that a court decides disputes about the class and representative action waiver, the public injunctive relief provision, and whether you opted out.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may ask a court for an injunction to stop the infringement or misuse of intellectual-property rights. Nothing in this section waives your right to seek public injunctive relief where California law does not allow that right to be waived; any claim for public injunctive relief will be decided by a court after the arbitrable claims are resolved, and the court proceeding will be paused until then.
How arbitration works. The American Arbitration Association (“AAA”) will administer the arbitration under its Consumer Arbitration Rules, and, when they apply, its Mass Arbitration Supplementary Rules, available at adr.org. A single arbitrator will decide the Dispute. The arbitration will take place by video, by telephone, or on written submissions where the rules allow, or otherwise in the county where you live or in Sacramento County, California. Fees are allocated as the AAA’s rules require, and Velotone will pay the fees that California law requires the business to pay. An invoice for those fees is due 30 days after Velotone receives it, unless the law requires a shorter time. The arbitrator may award the same individual relief a court could award, and the award may be entered in any court with jurisdiction.
Class and representative action waiver. You and Velotone may bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person and may award relief only to the individual party seeking it and only to the extent needed for that party’s individual claim. If this waiver is found unenforceable as to a particular claim or remedy, that claim or remedy, and only that one, will be severed and decided by a court after the arbitrable claims are resolved.
By agreeing to arbitration, you and Velotone each waive the right to a trial by jury for any Dispute resolved in arbitration.
Your right to opt out. You may opt out of this agreement to arbitrate by sending notice to support@pianoracer.com or to Velotone LLC, 2108 N St #4486, Sacramento, CA 95816, within 30 days after you first accept Terms that contain it. Your notice must include your name, your account email or username, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
Changes to this section. If Velotone makes a material change to this section after you have accepted it, you may reject that change by notifying us within 30 days after it takes effect, in which case the version you previously accepted continues to apply. This section does not apply to any claim filed in court before you accepted Terms containing it.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except that the Federal Arbitration Act governs the agreement to arbitrate.
Any Dispute that is not subject to arbitration, including because you opted out, will be brought exclusively in the state or federal courts located in Sacramento County, California, except for claims that qualify for small claims court where you live. You and Velotone consent to personal jurisdiction in those courts.
The section for the UK, the EEA, and Switzerland below changes this section for people who live there.
Apple App Store
If you use the Piano Racer app downloaded from Apple’s App Store, these Terms are between you and Velotone only, not Apple. Velotone, not Apple, is solely responsible for the app and its content.
Your permission to use the app is a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the App Store’s terms, except that other accounts associated with you through Family Sharing or volume purchasing may also use it.
Velotone is solely responsible for maintenance and support of the app, as described in these Terms and as required by law. Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the app’s purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Velotone’s responsibility, to the extent these Terms do not disclaim them.
Velotone, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims under consumer-protection, privacy, or similar laws. If a third party claims that the app or your possession and use of it infringes that party’s intellectual-property rights, Velotone, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties. When using the app, you must also comply with any applicable third-party terms, such as your wireless data service agreement. Questions, complaints, and claims about the app go to Velotone at the addresses in the Contact section.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right, and will be deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
Electronic communications and notices
You agree that Velotone may provide agreements, notices, and other communications to you electronically, through the service or at your account email, and that these satisfy any requirement that they be in writing. Legal notices to Velotone must be sent to the addresses in the Contact section.
General terms
These Terms and the Privacy Policy are the entire agreement between you and Velotone about the service and replace any earlier understanding. You may not assign or transfer these Terms without Velotone’s written consent. Velotone may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets.
If we do not enforce a provision, that is not a waiver of our right to enforce it later. Section titles are for convenience only. Except as stated in the Apple App Store section, these Terms do not create rights for any third party.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be applied to the greatest extent permitted by law, and the remaining provisions will remain in effect.
Changes to these Terms
Velotone may update these Terms as the service changes.
Updated Terms will include a revised effective date. For a material change, Velotone will tell you through the service and, where appropriate, ask you to accept the updated Terms. If you already have an account, a material change applies to you from when you accept it or, if you keep using Piano Racer without accepting it, 30 days after we first tell you about it through the service, whichever comes first. Any purchase you make after updated Terms take effect is made under them.
Except as just described, your continued use of Piano Racer after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law. If you do not agree to updated Terms, stop using the service; you can delete your account at any time. Changes to the Dispute resolution section are also subject to the rejection right described there.
If you live in the UK, the EEA, or Switzerland
If you live in the United Kingdom, a country of the European Economic Area, or Switzerland, this section applies to you and prevails over anything else in these Terms that conflicts with it.
- The Dispute resolution section, including the agreement to arbitrate and the class and representative action waiver, does not apply to you. You may bring a claim in the courts of the country where you live, and we may bring a claim against you only there.
- California law governs these Terms, but you keep the protection of the mandatory consumer laws of the country where you live.
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit, and nothing affects your statutory rights, including your rights when digital content or a digital service is faulty. We are responsible for loss you suffer that was a foreseeable result of our breaking these Terms or failing to use reasonable care and skill; we are not responsible for loss that was not foreseeable. The Disclaimers, Limitation of liability, and Indemnification sections apply only as far as the law allows.
- Where coin packs are offered on the website, you may withdraw from a coin purchase within 14 days of making it, without giving a reason, for any of its coins you have not spent. To withdraw, contact us as described in the Contact section. For coins bought through Apple’s App Store, ask Apple, which handles cancellations and refunds of App Store purchases under its own terms. This does not affect your rights if a purchase is faulty or not delivered.
- We will give you reasonable advance notice of a change to these Terms that affects you materially. If you do not agree, you may delete your account before it takes effect.
